AGREEMENT

These terms apply to your use and/or download of Stylish Esper's (“we,“ “us,“ or “our“) games, applications, website (www.stylishesper.com) (“Website“), and services (collectively "Stylish Service") on any platform, including computers, mobile devices, websites, consoles, PCs, and any other platform. They also apply to any other services we offer, such as customer support, social media, and other websites we may operate. These terms are a legally binding agreement that contains important information about your rights and obligations regarding our Stylish Services.

To use our Stylish Services, you must be at least 18 years of age. If you are not at least 18, you must be at least 13 years of age and under the supervision of a parent or guardian who has read and agreed to these terms. By accessing or using our Stylish Services, you agree to these terms, including any future updates. If you do not agree to these terms, you must immediately stop using and/or accessing any and all of our services. By using our Stylish Services, you confirm and guarantee that you possess the appropriate right, authorization, and capability to agree to these terms and comply with all of the established terms.

If changes are made to these terms that require your action to accept the updated terms, you will be unable to continue using our services until such action is taken by you. By continuing to use our Stylish Services, even after any updates to these terms, you are indicating your acceptance of the terms and acknowledging the Stylish Esper Privacy Policy, which can be found at www.stylishesper.com/privacy-policy. Additionally, you confirm that your use of our Stylish Services complies with all applicable laws and regulations.

INTELLECTUAL PROPERTY

By using our Stylish Services, you understand and agree that:

  • we own all intellectual property rights in our Stylish Services;

  • you are allowed to use our Stylish Services only for use according to these terms and as long as no laws or rights of any persons are violated;

  • you are the only one that is allowed access to your account with any of our relevant Stylish Services;

  • you have no ownership or property interest in any of our Stylish Services, including online accounts, virtual currencies, or virtual items (“Virtual Goods“ or “Virtual Good“);

  • we may delete some or all of your data at any time as we deem necessary, including any account or Virtual Goods (causing you to lose access to a part or all of a Stylish Service or Virtual Good);

  • updates and patches to any of our Stylish Services or Virtual Goods are subject to these terms;

  • you cannot copy, transfer, redistribute, modify, reverse engineer, or create derivative works of our Stylish Services, parts of Stylish Services, or Virtual Goods unless we agree in writing.

VIRTUAL GOODS

Our Stylish Apps may contain Virtual Goods (a virtual currency or commodities provided to you as a result of a purchase made by you or other conditions as set by us). Your ownership of a Virtual Good is limited to a personal revocable license to use them. By using our Stylish Services, you agree that all sales of Virtual Goods are final, and we won't refund any transactions after validation. A purchase is considered complete when our servers credit the Virtual Good to your relevant Stylish Service account.

If a Stylish Service account has not been made by you, you are at risk of losing all data (including, but not limited to all Virtual Goods) in the event that your device is lost or destroyed, or the Stylish App, that uses such Virtual Goods, has been removed from your device. If the data is lost in this way, it cannot be restored.

We have the right to alter any Virtual Good at any time without any liability to you and without prior notice to you.

USER CONDUCT

You must follow applicable laws where you access our Stylish Services. If those laws restrict or prohibit you from using our Stylish Services, comply with those restrictions or stop using our Stylish Services. You promise to provide true, accurate, and complete information when using our Stylish Services. Content (information, data, software, sound, images, video, or other materials) uploaded or transmitted via our Stylish Services is the responsibility of the person who sent it. Do not upload objectionable or unlawful content, infringe on intellectual property rights, or use our Stylish Services for fraudulent or abusive purposes. You must not interfere with our Stylish Services, violate laws, cheat or use unfair means, or use our Stylish Services in any other unauthorized way. You cannot use cheats or technological measures designed to control access to our Stylish Services, including providing access to any of our Virtual Goods, whether free of charge or not. Your account may be locked or deleted if you violate these terms. If you suspect a violation, please contact us.

AVAILABILITY

Our Stylish Services or Virtual Goods (“Services“) may not always be error-free or available, but we will comply with legal standards. Paid-for aspects of our Services will meet their descriptions and be of satisfactory quality, while related services will be provided with care and skill. We can make updates to our Services without notice as long as it doesn't impact paid-for functionality. Free Services may be modified or discontinued without notice for economic or technical reasons. We're not responsible for events outside our control, but payment obligations will be suspended if significant functionality degradation occurs. We can modify or discontinue paid-for Services with reasonable notice.

LIABILITY LIMITS

Our Stylish Services come with no liability for damages caused by possession, use, or malfunction, such as personal injury or property damage, even if we were aware of the possibility of such damages. We are not liable for any loss or harm caused by unauthorized access to our Stylish Services by any person, including fraudulent use. Our maximum liability in such cases is limited to the license fee paid for the Virtual Good or any other aspect of our Stylish Services. Some jurisdictions do not permit limitations on implied warranties' duration or the exclusion of certain damages, so this warranty grants you specific legal rights, which may vary depending on your jurisdiction.

TRANSFER OF TERMS

We reserve the right to transfer some or all of our rights and responsibilities under these terms to a third party without your prior consent. Such transfer will not disadvantage you significantly, and you consent to it by agreeing to these terms. You are not permitted to transfer any of the rights granted to you by these terms without our written agreement.

COMPLAINTS AND CONCERNS

If you have any concerns regarding our Stylish Services or anything else related to Stylish Esper, please do not hesitate to contact us (see the "CONTACT" section of these Terms of Service). We take every concern seriously and will do our best to resolve it in a timely and efficient manner. If for any reason we are unable to reach a satisfactory solution, and you wish to take legal action against us, these terms will be governed in accordance with the laws of Ontario.

GOVERNING LAW

Stylish Esper, based in Ontario, Canada, controls, operates, and provides access to Stylish Services. These services can be accessed from various nations around the world. Any interpretation of these terms and claims of breach will be governed by the laws of Ontario, regardless of the conflict of laws principles.

WAIVER

Our failure to exercise or enforce any of our rights under these terms does not waive our rights and we may enforce them in the future. If we do choose to waive any of our rights, that waiver will only be effective if it is in writing and signed by us.

SEVERABILITY

In the event that any portion of these terms is deemed invalid or unenforceable under local or applicable laws, we will interpret that portion in a manner that aligns with applicable laws to reflect our original intent as closely as possible, and the remaining provisions of these terms will continue to be valid and enforceable. If it is not possible to interpret the invalid or unenforceable part in accordance with applicable law, then that portion should be deemed removed from these terms, and shall not affect the enforceability of the remaining provisions.

BREACH OF THESE TERMS

Your use of the Stylish Service begins on the date you first access it and continues until you terminate your user account and cease using the service. Stylish Esper reserves the right to delete, suspend, or modify your account or certain features of your account, remove any associated Virtual Good, or delete any other data related to your account. If you breach any of these terms, you agree to compensate us for any losses, harm, claims, or expenses that may result, in accordance with applicable law.

LINKS

We may provide links to third-party websites or services from our Stylish Services. You recognize that we make no warranties about the content, products, or services provided by such third parties, and we do not endorse them. We shall not be held responsible for any losses or damages caused by the actions of such third parties. You are solely responsible for any fees charged while using such third parties. You are aware that by sharing data with these third parties, you are subject to their own privacy policies if such policies exist, and our Privacy Policy does not apply to such data.

CHANGES TO THESE TERMS OF SERVICE

You can find the latest version of these terms at www.stylishesper.com/terms-of-service. Stylish Esper has the authority to revise these terms periodically by publishing the revised version at the same address. We may do so for various reasons, such as modifying the nature of our Stylish Services, legal or technical reasons, or changes in our business needs. If you do not agree to any modifications to our terms, you must cease accessing and/or utilizing our Stylish Services immediately.

ENTIRE AGREEMENT

These terms represent the complete agreement between you and us regarding our Stylish Services, superseding any previous agreements or understandings between us.
